Before entering the website, and previously to the execution of any action and/or use of any type of information from the website, or that may be obtained through the website, you are kindly requested to read carefully the terms for the use of the website.

About the Using Terms

1.      The terms for the use of “Y2buy” regulate the relationship between the operators of Y2buy’s website and (hereinafter: “the website operators”) the user. Therefore, a person that executes an operation in Y2buy and/or makes any use of the information of any type existing in Y2buy or of information obtained through Y2buy (hereinafter: “the user”) will be considered as if declared that read the User’s Terms and acknowledges them and agrees to the Using Terms.

2.      These User’s terms constitute a separate agreement between the User and the website operators. It is agreed and clarified that the website operators will not be liable towards the User in the event of infringement of these Terms by another User, and that in the event of any infringement by another User, the User will be entitled to claim only the infringing side and will not have any claim, demand and/or allegation towards the website operators.

3.      The website operators will be entitled to change these terms, from time to time and according to their sole judgment. The website operators will inform the user, within a reasonable in advance period, about these changes, the notification will be done through publication in the website and/or by E-mail, according to their best judgment and to the circumstances. The using period -of the services provided in the website- will be conditioned by the User’s agreement to the aforementioned changes.

4.      It is hereby agreed that only the mentioned in this agreement bind the website operators.

5.      Using Terms for the User who places books in the website

5.1. The user of this website declares that he/she read the Using Terms and that agrees to them and acts according to the stipulated by them.

5.2. The User confirms that is aware to the fact that this website is designed to be used as a website for the exchange of books and that should not be used for personal or business purposes and/or in order to promote the user’s interests, in any way other than the exchange of books.

5.3. The User certifies that all the data registered in the website is true and accurate.

5.4. The Users are requested to provide the precise and relevant details of the book proposed for exchange

5.5. The User is aware that to the extent that he/she publishes inaccurate facts, he/she is legally accountable according to the instructions of The Slander Prohibition Law – 1965, therefore the User undertakes to publish the truth.

5.6. The user undertakes to give his/her full and accurate personal details at the moment that the books are inserted in the website; the aforementioned, in order to permit to inquire about the accuracy of the data; and if necessary, to enquire about missing data.

5.7. The User agrees that the Website Management is entitled not to publish his/her book, according to their absolute judgment, moreover, the Website Management will be entitled to edit the data about the book.

Limited liability

6.      The website operators do not undertake and shall not be responsible for the goods or services purchased or attained through the website or for any other business transaction performed though the website.

7.      The website operators shall not be responsible for any damage or tort, direct or indirect, pecuniary or other that might be caused to the User as result from the use of the website. The User is fully aware that any use that he/she makes of the website is executed at his/her sole responsibility.

8.      It is clarified that the website operators are unable to trace, screen and control the contents inserted by the Users. Therefore, the responsibility -for the aforementioned contents- falls due only on the Users that placed them in the website and it will be at their sole responsibility to bare any damage and to indemnify the website operators for any suit filed due to the aforementioned contents.

9.      Notwithstanding the aforementioned, the website operators reserve their right to erase and to omit contents that contradict the using regulations of the website, according to their sole judgment. The decision of the website operators to do so will not be considered as their admission of responsibility for the contents that appear in the website and that were not placed by them.

10.  The website operators will not be obliged and/or responsible, either directly or indirectly, to give an incidental or an especial compensation deriving or resulting from the use or incapability to use the website’s services or due to unauthorized entrance or change of the User’s notifications or data, even if the website operators were informed about the possibility of such a loss.

11.  The service is proposed to the User as is, and the website operators will be liable for the entire adjustment to the Users needs and/or objectives. The User declares hereto that he is aware that the website operators are no liable for any use that he makes, directly or indirectly, of the service or its terms and that he/she is the sole and absolute responsible for any use that he/she makes –or will make- of the service.

12.  The website operators, including the managers, employees and anyone on their behalf, will not be liable for any damage, direct or indirect, caused to the User and/or to any third part due to the use of the information and/or content and/or due to the annulment and/or interruption of the service including due to disruptions and/or deficiencies in the transfer of information either if caused intentionally by any third part or if caused by any mishap

13.  The website operators make any reasonable effort -in the specific circumstances- to protect the Users’ data and his/her privacy, according to the privacy Declaration. Notwithstanding, the User releases the website operators from any responsibility for damage or tort, direct or indirect, pecuniary or other, caused to the User as result of leakage of these data, irrelevantly to the cause of the leakage.

14.  The website operators will not be liable, directly or indirectly, for any damage, pecuniary or other, caused to the User as result of the use or reliance on information that appears in Y2buy.

15.  Visitors’ using terms

15.1. The visitor to this website declares that he/she read the using terms and that agrees to them.

15.2. The visitor confirms that is aware to the fact that this website is designed to be used as a website for the exchange of books and that should not be used for personal or business purposes and/or in order to promote the user’s interests, in any way other than the exchange of books. The visitor knows that the data detailed for each book was delivered by the Users themselves and that responsibility for the accuracy of the facts falls due on the User that inserted the book.

15.3. The website operators will not be liable for any act of any type that may originate a relation between User and seller, even if the User learned about the Sales Website of the seller from Y2buy and/or approached the seller’s Sales Website through a link from Y2buy.

15.4. The website operators will not be liable for the quality of the products and/or services that proposes the seller, including the purchase terms and/or purchase procedures and/or supply of the products and/or any other thing proposed by the seller.

15.5. The information in Y2buy is offered bona fide for the User’s benefit; the offer of the information does not constitute a recommendation and/or an opinion and/or professional opinion regarding the product or Sales Website or the seller and/or the services proposed by the seller.

15.6. Y2buy has an accessory system for the benefit of the User including forums (hereinafter: “accessory”); the use of the accessory is personal, subjective and at the sole judgment and responsibility of the User. The website operators are not involved, in any way, in the data and contents or any other information received through the accessories. The website operators will not be liable for a third part and/or the User due to the implications of the use of the accessories and contents presented through the accessories. Without prejudice to the aforementioned, the website operators will be entitled to remove, erase, prevent and/or take any other step according to their sole judgment, at any time that they consider that was done or may be done improper and undeserving use of the accessories. Additional Using Terms that will be exhibited in Y2buy are an integral part of the mentioned in the using terms detailed in this document.

15.7. The website operators permit to any person to use the variety of services in Y2buy. However, the website operators will be entitled to remove information and/or to prevent or cease the use of Y2buy, in any case that the use of Y2buy is done in an improper and unreasonable manner, according to the sole judgment of the website operators.

15.8. The website operators prohibits the use of the existing services in Y2buy in order to express and/or distribute information or details which are illegal, troublesome, insulting, hostile, damaging, threatening, encourage to execute criminal offenses or calumnies, violate privacy or constitute any other infringement of the law.

15.9. The website operators will not be liable for the content of the publicity or any other commercial information published in Y2buy. The website operators will remove or prevent any publication that contradicts the law, starting the moment that the website operators are explicitly informed that the publication or any other information contradict the law.

15.10. Advertisement in Y2buy does not constitute a recommendation or opinion or expression of opinion or encouragement of the website operators, to buy the product exhibited in the advertisement and/or to use the service or information exhibited in the advertisement.

15.11. All the mentioned in the website statute, in relation to the limitation of liability of the website operators, applies to the advertisements in Y2buy, accordingly and with the necessary changes.

15.12. The website operators are neither advertisers nor promoters. The website operators facilitate the use of Y2buy –to advertisers and/or promoters- as an interface, and only for the exhibition of advertisements.

16.   Intellectual property

16.1. The copyright for the entire information and software as defined by the Computers Law 1995, including graphic design, registered mark and trade secrets, developed and/or designed and/or composed and/or created by the website operators by themselves or transferred to the website operators by another person, belong to the website operators.

16.2. Is not permitted to do any act, directly or indirectly, which constitute an infringement or damage to the intellectual property of the website operators, except if the website operators explicitly authorized to do so, in written and in advance.

16.3. The website operators consider the damage to others title law as a severe transgression, and will see the attempt to use Y2buy as a mean to infringe or damage the title law of third parts as a grave transgression.

16.4. An advertisement exhibited in Y2buy is the property of the publisher; therefore the advertisement should not be used in a way that may infringe the publisher’s right on the advertisement.
